Ned & Nancy’s Terms and Conditions
Throughout this document, Ned and Nancy's, the entity providing the goods or services, shall be referred to as the "Company." The term "Client" will be used to denote any user, authorized representative, or any other form of representation engaging with or representing the interests of the client in relation to the Company's offerings, products, or services. The use of these terms is intended to establish clarity and consistency in communication and understanding between the Company and the Client throughout the document.
Your rejuvenated Kitchen Cupboards, Bedroom Cupboards and FurnitureWe paint characterful, unique kitchens and furniture. If you are looking to create a manufactured, factory painted or spray-painted look, we are not the company for you.
We hand paint, with tried and tested techniques to replicate and achieve unique furniture and kitchen finishes with plenty of character and charm. Our application is through the use of specialist brushes and rollers that is designed to build up layers to create a durable finish. The paints we use lend themselves to these qualities and we have many years of experience which ensure we provide our customers with a quality characterful finish we hope will exceed all your expectations.
Artistic License We are a creative team and each job we undertake is different. The natural shape of the kitchen/furniture and surrounding elements and environment, all play a role in how we approach the project. We use our artistic discretion to maximize and utilize all of the above to ensure we give the best look and finish possible. We are skilled in many styles and techniques and some of these processes may require us to work inconsistently to ensure we get the best finish possible.
At Ned and Nancy’s this will include unconventional painting styles such as multi-directional brush strokes, layering of paint to create depth and character as well as contouring and styling with slight to moderate distressing, should the project call for this.
Please be advised that, as standard, we work with your existing kitchen cabinetry. We are in no way responsible or liable for poor existing carpentry, poor woodwork installations, or any associated faulty structure of the hardware or frames. We are painters and not installers, however, we will do our utmost to work with your existing cabinetry, structures and surfaces as laid out in our scope of work presented to you. We use specialised rollers and specialised undercoats and paint on cabinetry. This is to ensure we give plenty of character and charm to our projects. When the kitchen is painted in this style it blends into the surrounding environment and creates flow in the space, however, this in no way creates a “home-painted” look. We use our talent and years of professional experience to create beautiful spaces and projects.
PaymentsA 75% (seventy five percent) deposit is required upon acceptance of the quotation. The balance of payment is required within one (1) day of completion of the work. Should you fail to pay within the specified time period, 10% of the total outstanding balance will be added to the final invoice every 5 working days. If you fail to abide by these payment terms, Ned and Nancy’s will have no option but to hand over any outstanding payments to a debt collection agency, whereby, you will be fully liable for all legal and associated costs.
Should a legal matter, dispute or any legal jargon or action thereafter, arise you agree to fully cover all Ned and Nancy’s associates, contractors, employees and all persons in a personal or company representative role. This as well as associated, costs, time lost, legal costs, accounting costs, reputation damage pertaining to any matter that may arise regardless of the outcome. Should reputataThis includes but is not limited to all dealings with lawyers, solicitors, barristers, accounting fees and all associated expenses and court costs. You, the client are not able to enter into Force Majeure pertaining, but not limited to, the following: acts of God, war, riots, earthquakes, hurricanes, imposition of sanctions, lightning, pandemics, strikes, a change in law, governmental intervention or changes in legislation.
During the painting process, we undertake to paint all external cabinetry and surrounds. We do not paint the internal spaces i.e. the reverse of doors, inside of drawers or cabinets and shelves, unless it has been specified on your quote/ invoice. However, if these areas are exposed or they make up the inside of a glass cabinet or a glass-fronted door, we will paint according to our artistic discretion to ensure we make the best use of colour and technique. Should you require a quote to paint the reverse of the cabinet doors, we will provide you with a secondary quote.
We do not paint on the top of kitchen cupboards or underneath kitchen cupboards unless we feel that this is visible and ruins the flow of the design.If we are painting your kitchen, we will do our utmost to close gaps between walls and cabinetry using either white or grey silicone at our colour discretion.
Upon painting the kitchen cabinetry you may notice overpainting on the inside of doors and around corners and edges. Please rest assured that we would rather over-paint than under-paint and that all excess overpainting will be cleaned and your kitchen snagged on site on the final day.
Existing CarpentryWhen painting furniture and kitchens we are painting pre-loved/ used items. With regards to kitchens, these may be constructed out of a variety of woods, super woods, chipboards, laminates, etc. Whilst we will always do our utmost to go above and beyond expectations to ensure our service and workmanship are of the highest quality, we are limited by our environment and the materials we are working with. Therefore, we will not be held responsible or liable for faulty cabinetry, carpentry or any such thing which may impede the process or affect the overall outcome.
In most cases, existing kitchens have doors and cabinetry that no longer line up 100 %. We will do our utmost to re-adjust and re-align this cabinetry, however, we will not be held liable for misaligned pre-existing or gaps between cupboard doors or incorrectly hung doors, units and drawers.
We will endeavor to service or replace any faulty door hinges or drawer runners that we may encounter. If this exceeds 6 hinges, charges will be applicable. Please be advised we will replace hinges with hinges that are readily available to us.
If you require handles to be changed, we are happy to assist, provided that your new handles of choice align with the pre-existing holes. We will not re-fill existing holes as over time these are susceptible to sinking in and may affect the visual outcome of your project.
Client ExpectationsWhilst it is not necessary to unpack your cupboards, please remove all items from open or exposed shelves where we will be painting as we do not take responsibility for damages or breakages to items that we need to move. Please also clear the work countertops.
If you are politely requested either verbally or in writing to prepare your cabinets for painting, please assist us by washing them down gently with a sugar soap solution and ensuring all residue has been removed. This is available from leading hardware stores and the most popular supermarkets.
Whilst we understand the need for security, due diligence and care, please advise us of any security procedures that we may need to adhere to in your home or complex. Whilst our team does carry ID it is unfortunate that at times we are denied access to complexes and homes via security. Please ensure that you notify your security personnel of our presence on site and forewarn them that we will be arriving with a team and will need access throughout the day. If we are denied access on more than two occasions for reasons out of our control, we will deem the contract as fulfilled and we are entitled to pursue any outstanding funds owed to us even if the job is not completed.
If we are left on site without the homeowner or guardian present we will not undertake any key care duties unless otherwise pre-arranged before we commence. As much as we appreciate children onsite, please be reminded of the dangers as we carry sharp blades and power tools. Wet paint can also cause damage when placed near “little hands”, for which we will not be held responsible.
We are a professional, competent team experienced in a variety of painting techniques that ensure we meet your expectations and that the quality of workmanship is of the highest standards. To ensure that this workmanship is carried out in a timeous manner, please ensure there is somebody to allow entry and exit to the property throughout the duration of our time with you.

AftercareWhilst the wax/ lacquer/ paint/ undercoat and associated finishes are curing, please ensure that "little people’s hands", pets and greasy or dirty adult hands avoid contact with any surfaces. Please also avoid cooking anything greasy that may splash onto the newly coated surfaces. During this curing period is when staining is most likely to occur.
We use the best quality paints with high pigment content and specialised undercoating that is designed to work in conjunction with the paint for your kitchen. The paint we use is a tough water-based satin, resistant to reasonable household grime and reasonable knocks and chips. It is fast drying with low odour and non-yellowing. We will not be held responsible for chipping, marking, water damage, staining or oil marks on cabinetry or items we have worked on. The aftercare is up to you and your household. We will also not be held responsible for any abuse or damage caused after the completion of the job. These are painted surfaces and like any other painted surfaces, reasonable care must be taken to ensure longevity. Should you request us to use a specific brand of paint we are not familiar with or we know to be of poor quality we will not offer any warranty. Our warranty is in line with the paint or coating manufacturer’s warranty.
Should we be using a wax finish in place of a lacquer, we will leave you with a small amount of wax. Should marking occur, simply use a lint-free mutton cloth to gently apply wax to the affected area in a gentle circular motion. Then buff out the wax by gently polishing it with a lint-free mutton cloth.
Going forward, to care for your newly painted surface, please purchase a furniture polish that is designed for TV screens and electronic surfaces. We recommend both Mr Min and Pledge, available at all leading supermarkets. These polishes contain very little silicone, as silicone can start to break the wax down over time. Simply spray onto a lint-free mutton cloth and polish as you would polish any other furniture in your household.
The wax/ lacquer/ paint or associated finish we use is designed to create a water-repellent barrier. Should you accidentally drop something onto the cupboards, simply take a soft, damp cloth and wipe. Please do not use any chemicals or harsh cleaning products.
We believe in service. Should you have any queries or require further information please reach out and we will be on hand to answer and assist. We do understand that life can be busy and accidents do happen. If we are working on site and you do happen to drop something on an unsealed surface, please do tell us so we can use the correct product and rectify it to ensure a great finish. If you do have a major problem and damage is caused by a third party we are always willing to assist, our hourly call-out is R 495 per hour (minimum) to rectify any areas that have been mishandled. We do take photographs of our completed work.
Dissatisfaction with a Selected Color (colour) – Rebate: We do not offer rebates or refunds if a customer dislikes the chosen color.(Colour) for any services we offer. The final colour (colour) decision lies with the client.
Photo Guidelines for Consultation: High-quality, high-resolution photos, preferably with natural lighting, are recommended. The room should be clean, capturing the overall space. Multiple photos capturing different areas can be provided, ensuring optimal rendering quality for digital color options.
When you, the client (“Clients”) engage with Ned and Nancy’s through a Colour (Colour) Consultancy Services Agreement ("Agreement") as entered into either online, or in person by and between Ned and Nancy's ("Clients") and (“Clients”), either in your personal capacity, as representative and as a third party
Scope of Services: The Color Consultant shall provide professional advice and expertise regarding the appropriate use of color in the workspaces of corporate clients and corporations (“Clients”). The services may include but are not limited to color selection, color psychology recommendations, and strategies for creating an optimal visual environment.
Consultation Process: The Color Consultant shall conduct a thorough assessment of the Clients’ workspaces, taking into account their specific needs, branding requirements, and desired ambiance. The Consultant will present color recommendations and design proposals, subject to the approval of the Clients.
3. Professional Obligations: The Color Consultant shall exercise reasonable skill, care, and diligence in the performance of the services. The Consultant shall stay updated with industry standards and best practices related to color psychology, design, and workplace aesthetics.
Client Cooperation: The Clients shall provide the necessary information, access to the premises and or via digital imagery and any relevant documents and visuals required for the color consultation process. The Consultant relies on accurate and complete information to provide the best recommendations.
Intellectual Property: Any color schemes, design concepts, or recommendations provided by the Color Consultant remain the intellectual property of the Consultant. The Clients shall not reproduce, modify, or distribute the Consultant’s work without obtaining prior written consent.
Confidentiality: Both parties shall maintain strict confidentiality regarding any sensitive or proprietary information disclosed during the consultancy process.
Liability and Indemnification: The Color Consultant shall not be liable for any damages, losses, or expenses incurred by the Clients arising from the implementation of the color recommendations. The Clients agree to indemnify and hold the Consultant harmless against any claims, liabilities, or expenses resulting from the Client’s use of the color schemes or designs.
Termination of Services: Either party may terminate the color consultancy services with a written notice, specifying the reasons for termination. The Consultant shall be compensated for the services rendered up to the termination date.
Dispute Resolution: In the event of any dispute arising from this agreement, the parties agree to attempt to resolve the matter through amicable negotiations. If a resolution cannot be reached, the dispute shall be referred to mediation or arbitration as per the laws of the jurisdiction. Both parties agree to the use of a neutral professional arbitrator.
A color consultation is a collaborative discussion between the homeowner and a color consultant, where goals for interior or exterior paint colors are addressed, and recommendations are proposed to achieve these objectives. The consultation typically covers topics such as the desired mood or style, considerations about colors that may or may not suit the project, and coordination with existing elements. Ned and Nancy's conducts color consultations either through a Zoom link, sent to your email upon booking and payment, or in person, requiring full upfront payment for the selected service.
During your color consultation, the color consultant, based on information provided at the time of booking, undertakes pre-work to maximize the 30-minute session. The session begins with a discussion on the space, existing elements, and color goals. The consultant then shares pre-prepared ideas through a survey questionnaire to gather homeowner preferences.
Dissatisfaction with Consultation – You, as the client, are responsible for selecting the final paint, color, and finish for your project. The consultation assists in visualizing possibilities but does not guarantee the appearance of applied paint. Any dissatisfaction should be promptly communicated to us, and we aim to address concerns to your satisfaction.
Cancellation Policy: Consultations require a minimum 24-hour notice for full refunds. Cancellations within 24 hours are subject to a 50% service fee, with a 50% refund.
Rescheduling Policy: Appointments can be rescheduled without penalty up to 48 hours before the scheduled time to accommodate scheduling availability and respect for our color consultants.
"No Show" Policy: While understanding emergencies, clients who "no show" without notice will be charged the full consultation fee with no rescheduling option.
Photos are crucial for understanding your space and providing color renderings. Consultants use details from the questionnaire and evaluate colors pre-consultation, focusing on options apt for your home. Contact information is shared after the consultation for further queries.
Dissatisfaction with Selected Color – Rebate: We do not offer rebates or refunds if a customer dislikes the chosen color. The consultant provides three sets of three color options, leaving the final decision to the customer. Sampling colors before painting is encouraged to ensure satisfaction.

DecorumWe are guests in your home and we shall ensure we are respectful of your space. You can expect a courteous smile and a team that will do our utmost to solve a problem in a professional manner. We respectfully ask that we are treated in the same manner. We will under no circumstances tolerate discriminatory, abusive or threatening behavior. If this is encountered we will leave the site/end our contractual obligation with immediate effect and you will be liable for the balance of payment irrespective if the job is completed or not. You will not be entitled to any part payments or refunds.
In the event that the client wishes to alter the selected color after the commencement of work, whether the color was chosen by the client or recommended/selected by the company, the client shall be subject to an additional charge for the color change. The client agrees to bear all associated costs related to the modification of the chosen color, irrespective of its initial selection, and acknowledges the obligation to make such payment accordingly.
Governing Law and Jurisdiction: This agreement shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in The Republic of South Africa.
By engaging the services of the Color Consultant, the Clients acknowledge that they have read, understood, and agree to be bound by these terms and conditions. This agreement constitutes the entire understanding between the parties and supersedes any prior discussions or agreements, whether written or oral.
Changes to Terms of Use
Ned and Nancy's, referred to as the "Company," reserves the right to revise these Terms of Use and/or our Privacy Policy at any time. You are obligated by any such revisions, and it is advisable to regularly check this page to ascertain the prevailing Terms of Use and Privacy Policy to which you are bound. By utilizing the Websites or our services, whether in a virtual, in-person, or verbal context, you expressly agree to abide by the Terms of Use and Privacy Policy.
In the event of any legal matter, dispute, or subsequent legal proceedings, you hereby agree to indemnify and hold harmless all individuals associated with Ned and Nancy, including associates, contractors, employees, and any persons acting in a personal or representative capacity, against any and all costs incurred. This indemnification encompasses legal costs, accounting expenses, and any harm to reputation arising from any such matter, irrespective of its final resolution. Furthermore, it is explicitly understood that the client is precluded from invoking Force Majeure, including but not limited to acts of God, war, riots, earthquakes, hurricanes, imposition of sanctions, lightning, pandemics, strikes, changes in law, governmental intervention, or alterations in legislation, as grounds for non-performance or exemption from the aforementioned indemnification obligations.
Furthermore, it is explicitly understood that the client is precluded from invoking Force Majeure, including but not limited to acts of God, war, riots, earthquakes, hurricanes, imposition of sanctions, lightning, pandemics, strikes, changes in law, governmental intervention, or alterations in legislation, as grounds for non-performance or exemption from the aforementioned indemnification obligations.
Ned and Nancy's Directors, Agents, Affiliates, Employees, Third Parties, and Contractors expressly disclaim any personal or private liability for any loss, injury, death, financial consequences, accounting issues, delays in service deliverability, or damage of any nature. By placing or making a payment or deposit with us, you acknowledge and agree to these terms and conditions in their entirety.
It is hereby clarified that individuals and entities associated with Ned and Nancy, including Directors, Agents, Affiliates, Employees, Third Parties, and Contractors, are absolved from assuming any responsibility in their personal or private capacity for the aforementioned matters.
Moreover, we retain the right to invoke Force Majeure on our part in events such as, but not limited to, acts of God, war, riots, earthquakes, hurricanes, imposition of sanctions, lightning, pandemics, strikes, a change in law, governmental intervention, or changes in legislation. This reservation encompasses any potential impact on our ability to fulfill contractual obligations.
Client Consent and Acknowledgment
By engaging with our services, the client hereby expressly agrees to adhere to, accept, and be bound by the terms and conditions, as well as all policies established by Ned and Nancy's ("the Company") in their entirety. The client acknowledges and understands the implications, requirements, and obligations set forth in the said terms and policies.
The Client agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, representatives, contractors, third parties, and assigns (collectively referred to as "Indemnified Parties") from and against any and all claims, actions, suits, demands, judgments, liabilities, costs, expenses (including, without limitation, reasonable attorneys' fees), damages, and losses arising out of or related to any act, omission, or misconduct of the Client, whether in their personal or work capacity, that causes reputational damage, business slander, harm, or any other form of damage to the Company or the Indemnified Parties.
Scope of Indemnification: The Client acknowledges and agrees that the indemnification obligation under this Agreement extends to, but is not limited to, any harm, slander, or damage caused to the Company's representatives, contractors, third parties, and employees either in their personal or work capacity.
Compensation for Damages: In the event that the Client causes harm, slander, or any form of damage covered under this Agreement, the Client accepts and understands that they will compensate the Company for any and all damages incurred, including but not limited to loss of income, legal fees, and all additional costs related to repairing the Company's reputation.
Notice and Defence: The Client shall promptly notify the Company in writing of any claim or action for which indemnification is sought under this Agreement. The Company shall have the right to assume the defence of any such claim with counsel of its choice, and the Client shall cooperate fully in such defence and cover, in full all and any fees associated with the company or parties including, without limitation, attorneys fees and all associated costs.
Furthermore, the client affirms that they are duly authorized and possess the full consent of the home owner, landlord, or any other relevant entities to undertake the specified and requested work. The client acknowledges that they have obtained all necessary permissions and approvals required for the intended scope of work.
Additionally, the client confirms that they are over the age of 18 years at the time of providing this consent and acknowledgment.
This consent and acknowledgment are considered valid and legally binding upon the client when engaging with the Company's services.
